<\/a> Students have the right to be judged fairly, to be treated with respect, free of harassment and secure in their privacy as individual citizens. The University has policies and procedures which intend to assure these rights.<\/p>\n Students should inform themselves of rules governing college requirements, registration, academic standards, student activities, student conduct, parking, and similar matters, for they are held responsible for knowing and abiding by them.<\/p>\n The University Catalog<\/em> not only enables prospective students and others to learn about ÐÓ°É´«Ã½, but it also states University policies, requirements, regulations, and procedures. This Catalog<\/em> represents a flexible program of the current curricula, educational plans, offerings, and requirements which may be altered by the University from time to time to carry out academic purposes and objectives. The University reserves the right to change any provision, offering, or requirement at any time within the student’s period of study at the university. Rules and regulations of this Catalog<\/em> supersede those stated in previous bulletins.<\/p>\n The University expects all students to obey the law, to show respect for and obedience to properly constituted authority, to fulfill contractual obligations, and to maintain absolute integrity and a high standard of individual honor in academic work. It also expects from its students a higher standard of conduct than the minimum required to avoid disciplinary action. The program’s discipline is administered by the Office of \u00a0Student Life in accordance with the Student Policy and Procedure Manual<\/a>, copies of which are provided to new students at Orientation.<\/p>\n The experience of living on campus is one of the most important phases of University life. The Board of Supervisors for the University of Louisiana System places the welfare of the student as the top priority in the establishment and operation of all higher education institutions. Positive Board action has been taken in the acquisition and construction of essential housing, dining, student life, and academic facilities for the established institutions. The Board expects students to utilize these facilities to their fullest and in the best interest of all concerned. Therefore, all undergraduate students with less than 90 hours are required to live on campus unless they live at home within the 45 minute commutable range. Exceptions are granted for married students, students with dependents and students living at home. For more information, contact the Office of Residential Living located in the Brady Residential Complex Clubhouse, or call (985) 448-4479.<\/p>\n Students attending ÐÓ°É´«Ã½ are hereby informed of their right of access to their official records as described in the federal Family Educational Rights and Privacy Act and of the confidential nature of those records.<\/p>\n The federal act further provides that directory information about the student may be released by the University unless the student completes a form in the Office of Records and Registration within two weeks after the final day of registration for a semester, or within one week after the final day of registration for a summer session. This must be renewed each semester or summer session.<\/p>\n The following is considered directory information: the student’s name, address, telephone listing, electronic mail address, date and place of birth, major field of study, classification, full-time or part-time status, participation in officially recognized activities and sports, weight and height of members of athletic teams, dates of attendance, degrees and honors\/awards received, the most recent previous education agency or institution attended, and photographs (for public relations purposes only).<\/p>\n Further information may be obtained from the Office of Records and Registration.<\/p>\n Notification of Rights under Family Educational Rights and Privacy Act for Postsecondary Institutions<\/strong><\/p>\n The Family Educational Rights and Privacy Act (FERPA) affords students certain rights with respect to their education records. They are:<\/p>\n Students should submit to the registrar, dean, head of the academic department, or other appropriate official, written requests that identify the record(s) they wish to inspect. The University official will make arrangements for access and notify the student of the time and place where the records may be inspected. If the records are not maintained by the University official to whom the request was submitted, that official shall advise the student of the correct official to whom the request should be addressed.<\/p>\n Students may ask the University to amend a record that they believe is inaccurate or misleading. They should write the University official responsible for the record, clearly identify the part of the record they want changed, and specify why it is inaccurate or misleading. If the university decides not to amend the record as requested by the student, the University will notify the student of the decision and advise the student of his or her right to a hearing regarding the request for amendment. Additional information regarding the hearing procedures will be provided to the student when notified of the right to a hearing.<\/p>\n One exception which permits disclosure without consent is disclosure to school officials with legitimate educational interests. A school official is a person employed by the University in an administrative, supervisory, academic or research, or support staff position (including law enforcement unit personnel and health staff); a person or company with whom the University has contracted (such as an attorney, auditor, or collection agent); a person serving on the Board of Supervisors; or a student serving on an official committee, such as a disciplinary or grievance committee, or assisting another school official in performing his or her tasks. A school official has a legitimate educational interest if the official needs to review an education record in order to fulfill his or her professional responsibility. Upon request of another institution, the University discloses education records without consent to officials of such an institution in which a student seeks or intends to enroll.<\/p>\n [Back<\/a>] [Top<\/a>] General complaints related to this policy typically involve unfair treatment, generally unequal treatment, substandard physical facility conditions, behavior that a student may feel is unjust or creates unnecessary hardship, or other general concerns that warrant actions and are not included in the exclusions list below which have separate complaint policies and protocols.<\/p>\n Considerations for the process:<\/p>\n Filing of Initial Complaint<\/u><\/p>\n The student must file the complaint within 6 months of the date the alleged incident occurred.<\/p>\n Appeal of Resolution of Initial Complaint<\/u><\/p>\n If the student does not agree to a resolution as proposed:<\/p>\n Should the student not find the outcome of the first appeal to be satisfactory, they may continue to the next officer in that chain of command with the same ten (10) day turnaround time with the University President being the final level of appeal.\u00a0 The President may choose to have the President\u2019s Cabinet review the case and submit a recommendation.<\/p>\n The student may appeal the president\u2019s decision to the Board of Supervisors for the University of Louisiana System. The Board\u2019s review of the matter will be limited to a determination of compliance with established and appropriate procedures at the institutional level.\u00a0 The final decision will be conveyed to the student in writing from the University President\u2019s office.<\/p>\n Documentation and Record of Process<\/b><\/em><\/p>\n All documentation throughout the process must be maintained by officials involved and submitted into the Maxient system with the final resolution outcome signed by the student and the last official addressing the case.\u00a0 The Dean of Students office will assist those who do not have direct access to that system.<\/p>\n The student is assured that no retaliatory action will be taken against them for filing and pursuing the resolution of a complaint. All written and otherwise recorded materials relating to the filing and resolution of student complaints are to be considered education records, and, as such, are protected by the Family Educational Rights and Privacy Act (The Buckley Amendment).<\/p>\n Exclusions<\/b><\/em><\/p>\n The general complaint process does not apply to certain situations that may have specific sets of protocols for response governed by other entities, regulations, or mandates.\u00a0 The list below addresses most of these but should not be considered exhaustive.\u00a0 If you are looking for a particular area that is not on this list, please contact the Dean of Students office for assistance.<\/p>\n Academic Grievance<\/a> Institutional Accountability and Complaint Information<\/b><\/em><\/p>\n The State of Louisiana and the U. S. Department of Education have mandated that institutions of higher education have in place a specific procedure for the resolution of student complaints. State and federal governments are most interested in complaints that involve: 1) the mismanagement of federal financial aid funds and 2) false representation of programs and courses of study that may appear in an institution\u2019s various publications.<\/p>\n Additionally, ÐÓ°É´«Ã½ is accredited by the Southern Association of Colleges and Schools Commission on Colleges.\u00a0 More information on accreditation can be found on the University\u2019s accreditation page,\u00a0https:\/\/www.nicholls.edu\/about\/accreditation\/<\/a>.<\/p>\n Although ÐÓ°É´«Ã½ adheres strictly to all rules and regulations and represents as clearly as possible to students the information pertaining to their education here, students who may have complaints in any of these areas are encouraged to bring them to the University\u2019s attention through the procedure outlined above. A member of the ÐÓ°É´«Ã½ community who believes that he or she has suffered discrimination by being denied rights assured by federal and state anti-discrimination laws may file a complaint with either the Dean of Student Life (student complainant) or the Director of Human Resources (faculty or staff) or any other appropriate officer of the University. The complaint will be processed according to the procedure set forth in the Code of Student Conduct.<\/p>\n Electronic mail (e-mail) is an official method of contact between the University and students. This e-mail contact applies to all forms of communication including but not limited to matters concerning admissions, registration, financial aid, and academic affairs. Students are given e-mail addresses after their initial registration. Students should check e-mail at least once a week. The University provides computer access for all students by way of open computer labs. For information concerning the use of e-mail and the availability of computers, check the Academic Computing website at https:\/\/www.nicholls.edu\/information-tech\/<\/a> for more information.<\/p>\n The university has a specific policy governing the use and abuse of its computer resources. Students granted access to University computing facilities are required to abide by the established policy for computer use. The policy is stated in the Code of Student Conduct<\/em>.<\/p>\n The policy against computer abuse is a comprehensive one dealing with all aspects of computer abuse, whether physical or logical. It applies to all university computing facilities including mainframes, minicomputers, microcomputers, and associated equipment and links, as well as software, whether developed by ÐÓ°É´«Ã½ or purchased.<\/p>\n ÐÓ°É´«Ã½ strives to create an environment which promotes and reinforces health and responsible living, within the context of its educational mission. To this end, and because of the risks to the health and safety of the individual and community, the University opposes the abuse of alcohol and any other drug.<\/p>\n The University is committed to upholding all local, state, and federal laws concerning the use and abuse of alcohol and other drugs, and it will support efforts in the campus community to confront violations of these laws.<\/p>\n The following principles guide the University policy regarding the use of alcohol and drugs:<\/p>\n <\/a><\/p>\n [Back<\/a>] [Top<\/a>]<\/p>\n Use of Tobacco Products<\/strong><\/p>\n A. The use of any tobacco product in any form (smoking or chewing) is prohibited effective January 1, 2011. This applies to all students, faculty, staff, contractors and visitors on all ÐÓ°É´«Ã½ properties including the main ÐÓ°É´«Ã½ campus, Duhe Building, Chauvin Garden, etc. <\/a><\/p>\n [Back<\/a>] [Top<\/a>]<\/p>\n It is the policy of the university that no member of the academic community may sexually harass another. Sexual harassment is defined as:<\/p>\n Students at ÐÓ°É´«Ã½ are expected to be partners in the process of fulfilling the mission of the University by creating and maintaining standards within student groups, team and organizations that are conducive to personal growth and development. If student groups, teams, and organizations are to play an integral part in the University’s plan, they must set standards that challenge each individual to achieve his or her greatest potential.<\/p>\n Hazing is the antithesis of this goal, in that it attempts to tear down the feelings of individual pride and self-esteem of the individual, supposedly in order to create some esprit de corps in the group. Furthermore, ÐÓ°É´«Ã½ adheres to the University of Louisiana System Policy (Effective: 8\/23\/18), the Louisiana Board of Regents Uniform Policy on Hazing Prevention and upholds all LA statutes related to hazing. <\/a>Student Complaints and Their Resolution<\/strong><\/h5>\n

\nProcedure for Resolution of General Student Complaints<\/em><\/strong>
\nStudents are encouraged to seek informal resolution of complaints with the individual or department with whom the issue is associated.\u00a0 If the result is unsatisfactory to the student or directly approaching the individual or department is inappropriate or unsafe, students may file a formal written complaint by completing the\u00a0General Complaint and Reporting Form<\/a>\u00a0which can also be found on the web pages of Student Affairs, Dean of Students, Student Policy and Procedure Manual, University Police, Student Government Association, and Human Resources.\u00a0 Complaints received through email or direct message on social media will receive a reply with the link to the reporting form and directive to complete that form.\u00a0 Although anonymous complaints will be accepted, this may affect the outcome and resolution or delay the process.<\/p>\n\n
