of Fraud"},"content":{"rendered":"<p>Regardless of the definition used, certain characteristics are common to fraud, including:<\/p>\n<p>Misrepresentation of a material fact<\/p>\n<ul>\n<li>Made knowingly and with the intent to deceive<\/li>\n<li>Reliance on the misrepresentation by the victim<\/li>\n<li>Resulting in injury or damage from such reliance<\/li>\n<\/ul>\n<p>The perpetrator\u2019s intent to deceive is usually the hardest element of a fraud to prove.\u00a0 The following are examples which have been used to prove an intent to deceive:<\/p>\n<p>Admissions<\/p>\n<ul>\n<li>Alteration of documents<\/li>\n<li>Concealment of evidence<\/li>\n<li>Confessions<\/li>\n<li>Destruction of evidence<\/li>\n<li>False statements (lies)<\/li>\n<li>Obstruction of justice<\/li>\n<li>Pattern of conduct (repetition of behavior)<\/li>\n<li>Personal gain<\/li>\n<li>Testimony of a co-conspirator<\/li>\n<\/ul>\n<p>\u201cOrdinary\u201d people commit frauds.\u00a0 Typically, the \u201cordinary\u201d person has a \u201cpressure\u201d in his\/her life (e.g. financial crisis, large gambling debts, or high medical bills).\u00a0 Then, he\/she seizes a perceived \u201copportunity\u201d to alleviate the pressure (e.g. the combination is taped to safe\u2019s door, or no one ever reviews my work).\u00a0 Afterwards, he\/she rationalizes the fraud he\/she committed (e.g. they don\u2019t pay me enough, I\u2019ll pay it back, or I deserve a raise).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Regardless of the definition used,
