{"id":1361,"date":"2008-04-02T09:28:45","date_gmt":"2008-04-02T14:28:45","guid":{"rendered":"https:\/\/www.nicholls.edu\/police\/policies\/alcohol-drugs-and-tobacco-products\/"},"modified":"2020-12-15T16:35:00","modified_gmt":"2020-12-15T16:35:00","slug":"alcohol-drugs-and-tobacco-products","status":"publish","type":"page","link":"https:\/\/www.nicholls.edu\/police\/cleary-act\/policies\/alcohol-drugs-and-tobacco-products\/","title":{"rendered":"Alcohol, Drugs and Tobacco Products"},"content":{"rendered":"<p>ÐÓ°É´«Ã½ prohibits unlawful manufacture, distribution, possession and use of any narcotics, barbiturates, amphetamines, marijuana or any other controlled substance as defined in Schedule I through V of Section 202 of the Controlled Substance Act (21 U.S.C. 812) and as further defined by regulation at 21 CFR 1308.11 through 1308.15.<\/p>\n<p>The university prohibits the unlawful use or sale of any alcoholic beverages as well as their possession or consumption in any form on the university campus except in those areas where the president or his designee has authorized the serving or sale of legal beverages in accordance with applicable policies and laws.<\/p>\n<p>Any person in violation of the above policies will be subject to disciplinary action, up to and including termination of employment or suspension from the university, and unlawful violations will be subject for referral to the appropriate authorities for prosecution. Revocation of certain federal licenses and benefits, e.g., pilot licenses, public housing tenancy, etc., are vested within the authorities of individual federal agencies.<\/p>\n<p>Students and employees who have violated any of these policies may be required to participate in an alcohol\/drug abuse assistance program or rehabilitation program.<\/p>\n<p>Students, visitors, and employees are expected to adhere to all federal, state and local laws.<\/p>\n<p><strong>The following principals guide the university&#8217;s policy regarding the use of alcohol and other drugs:<\/strong><\/p>\n<ol>\n<li>Students, faculty and staff are expected to take full responsibility for their own choices and behavior.<\/li>\n<li>Abstinence is encouraged and respected in all circumstances.<\/li>\n<li>Activities and functions without the consumption of alcohol are to be promoted.<\/li>\n<li>The consumption or possession of alcoholic beverages is prohibited on campus except in those areas or for specific events approved by the president, all serving, consumption and possession must be done in accordance with university policy and local and state law.<\/li>\n<li>Heavy consumption of alcohol and use of all drugs are discouraged.<\/li>\n<li>Assistance for alcohol and drug abusers is to be provided through education, counseling and referral, in conjunction with the Drug-Free Workplace Act of 1988, all employees are on official state business or on call for duty, whether on or off the work site. Failure to comply with policy may result in disciplinary action up to and including termination.
