SENATE MEETING October 6, 2025 The meeting was called to order in the Leaders Suite at 4:00 p.m. Presiding officer was Vice President Adriana Magallon. The Recording Secretary was Dolly McGeever. The prayer was led by Director Ryan Bergeron and the pledge was given by Senator Maverick Dufrene. The Ӱɴý Student Government Association Mission Statement was read by Senator Jaiden Valure and Senator Riley Brantley read the first value of the Ӱɴý Creed. The following Executive Board members were present: President Cruz Cassard, Vice President Adriana Magallon, Vice President Pro-Tempore Evan Louviere, Treasurer Ethan Gisclair, Director of Student Rights & Grievances Justin Helper, Director of Public Relations Callie Becnel, Religious Liberty Director Ryan Bergeron and Secretary Dolly McGeever. Guests present were Mr. Terry Braud, Executive Vice President for Finance and Administration, Dr. James Stewart, Department Head and Professor of Mass Communications and Bridge to Independence student. Minutes were not presented for approval. GUEST SPEAKER: Dr. James Stewart President Cruz C. introduced Dr. Stewart what would be speaking about Open Meetings Law since SGA is a public body under state law. Hes going to advise the dos and donts and other references. Its an honor to have him come speak to the SGA on this. Dr Stewart said he teaches Communication Law just wanted to share a couple of things. The State of Louisiana like a number of other states have rules on meetings of public bodies. That encompasses the Student Government Association. Its not specifically stated in the statute. Actually, the Open Meetings Statute is found in the Louisiana Code and I can get a copy of that for you. The Attorney Generals office has ruled that Student Government Associations at state universities are public bodies for the purpose of the law. It's also important to know that this states Open Meetings Law has at the beginning of it, what is called The Statement of Legislative Intent, meaning that theres a gray area in the law. This is how our courts would be instructed to evaluate the law. The Statement of Legislative Intent says that whenever theres a gray area found in favor of yes, this body is going to be governed by the statute, and yes, that body has to do certain things to stay in accord with that. So, what does that mean in practice? Well, one of the basic things is at least 24 hours in advance of a meeting of this body or any bodies that meet under its director. So, you have for example a Supreme Court Committee. What are some of the other committees you have? Judiciary and the others. All of those, because they answer to this body, are also covered by the Public Meetings Law. So, 24 hours in advance of those meetings, you are supposed to post an agenda saying this body will meet Monday at 4:00 p.m. and these are the agenda items. I assume, and I dont know that this is particularly stated in the law, that excludes weekends so youd really want this posted by Friday afternoon so it would be 24 hours in advance. The agenda can be amended. Theres a process for that. You can add things to the agenda once the meeting gets started but that original announcement is supposed to include that information. Once the meeting is GUEST SPEAKER CONTINUED: underway, youre supposed to allow a certain amount of time in each meeting for public comment but you can set rules on how it works. Just because, for example, you give me a microphone and I decide to stand up here for three or four hours talking, you can put caps on that but you have to have a public comment section. Also, the public at large is allowed to attend and record the meeting. If the recording equipment would in some way be disruptive, and I cant really imagine that because in most times someone is using their cell phones and you wouldnt event know it unless they told you. That could be limited. Other than that you have to let people observe and record the meetings. You can go into what is called Executive Session and thats where you take a vote and you say were going to go into an executive session for a particular purpose. Ill come back to that in a second and then you can ask anyone to leave this space that youd like to. You can conversely keep whoever youd like to within that space. However, in order to justify Executive Session, theres only a hand full of reasons that would justify that. For example, the most common probably is to discuss someones character and competence. So, lets suppose you had a member of this body who is facing some sort of disciplinary action and you wanted to have a discussion about that, that would probably be covered. Other sorts of things really wouldnt apply. For example, School Boards that are in negotiations with collective bargaining, talking to their attorneys wouldnt apply here. If we were chasing engaging here in South Louisiana, I dont think youd be called on to plan the defense. So, your biggest one is going the be the character and incompetence thing. In order for that to work, then one member of this body would have to make a motion to go into Executive Session. I think it requires a 2/3rds vote to approve it. Now lets say youre talking about someones character and competence and youre talking about me, I have the right to tell you I dont want it done in Executive Session, I want it done in a public setting. So, other than that, if you go into Executive session, then you can discuss this matter but you cant do anything like straw pulling or asking how should we vote when we go out into Regular Session. When you return to Regular Session, thats when somebody would make a motion to take a particular course of action and then you would debate on whether or not thats a good idea. Following the meeting, you have to publish the minutes of the meeting. Ive seen Ms. Dollys notes. Theyre very extensive. A lot of groups dont have such extensive notes but thats a public document. So when people want to see copies of that, theyre allowed to both look at that and make copies of that. If for some reason someone believes that this body has conducted its operations in violation of the law, theres a number of different recourses that they can take in terms of filing lawsuits or filing complaints with law enforcement like the District Attorneys office or the Attorney Generals. There are enforcement proceedings and penalties that would be associated with that. So, thats pretty much a brief summary of what the statute says. I would also encourage certain senior officers here or your E-Board, to look into the group of Public Affairs Research Council of Louisiana that is a non-partisan group. That group is interested in access to government responsibility and they publish some really good documents and explanations that go into more details that Ive gone over briefly today. Thats a good resource for you to use if youd like to check that out. One other thing related to this. Were talking about meetings but by extension, the documents produced by this body would also be considered public records. Thats a whole other discussion. Who is Uncle Ben? Hes Spidermans Uncle. GUEST SPEAKER: Mr. Terry Braud Im Terry Braud, Executive Vice President here at the University. Dr. Clune has an event downtown and asked me to stop by and give you a little bit of an update. In no particular order, talking about Facilities, you may or may not have heard that Starbucks is coming to campus. Thats part of the new Sodexo contract that we started last year. You might have actually seen surveyors on Audubon. Itll be located at the corner of Audubon and Afton, directly in front of Max Charter. This is going to be a full service facility. Originally, it was supposed to be a Drive-Thru only. Starbucks folks have changed their business model so now there will be dining in as well as some dining out patio area and a drive thru. Its scheduled to be complete in Fall of 2026. GUEST SPEAKER CONTINUED: Also, as the Coastal Center has come online, BTNEP currently located on the first floor of North Babington until about a month ago moved out of that space and into the Coastal Center. Dr. Caruso is working with Housing and Facilities, looking at exploring options for that space. Eventually, that will be turned back into a student experience area. Whether that will be residential or common space is still to be identified. Then the third floor of Scholars Hall to date. We have done reflooring program on some common areas as well as some first and second floor of Scholars Hall. During the Christmas Break, when you all go home and enjoy yourselves for a little while and before you come back for the Spring Term, well be finishing off Scholars Hall and doing the third floor. Notice will be going out to Housing so the students in that particular area will know what to expect, when to expect it and how to prepare for that. We just wanted to share that with you as leadership on the university. Speaking of leadership on the university, the university has engaged with a third party consultant to develop a Strategic Enrollment Plan. We all know based on the data thats come out in Fall 2025, overall enrollment is down, probably about 150 or so students year over year. We recognize that a large portion of our operating budget comes from the tuition and fees paid by students. So, when that number goes now, theres a little less revenue to help manage the operating side of the business. This strategic enrollment partner actually worked with Southeastern over two years ago. It was very successful in helping them engineer a plan. Its a broad range plan with about five different working groups dealing with enrollment, communications, marketing processes, etc. Several of you as leadership will be serving on those working committees. If you have not yet been contacted, please look for that contact. We want to get not only faculty, staff and other support in those working committees and their voices but we also want to hear from students as well. We appreciate your leadership. We appreciate your planning to participate in that. The overall kick off and the working committees, probably about two or three weeks ago, were formed. The working committees will come back together in November for preliminary findings and information and action plans thats going to turn into a full blown plan by April. As we move throughout this fiscal year or academic year, there could be elements that we could begin to launch sooner rather than later because we might be in a position to do that. If not, all of the plan would likely be implemented by Fall of 2026. Overall goal, obviously, is to make sure that we communicate with existing students but also potential students. On top of that, recruitment, retention, the ability of Ӱɴý to meet your demands and the demands of our business partners as well. On the operating budget, I know theres been some talk. Dr. Clune also recognized that theres been some talk in the newspaper and other forms of social media and so forth, talking about the operating budgets at some other universities. We just want to remind you the strategic steps that we, Ӱɴý, took two years ago. We addressed that issue head on. We resized our operating budget. Im happy to report, Ive shared this with Dr. Clune, Im sharing this with you and this week we actually had a budget review committee meeting. Thats a committee that meets from across campus, our operating budget is in a good position, despite the slightly low enrollment. We can manage that. As well as on the athletic side, actions that weve taken with the athletic program and the potential impact that online betting taxes, would be coming to the university. Were in a much better place than some of our peers in the UL System and across the country. So, we thank you because you are part of those decisions that are being made. You are part, in many cases, in the conversations that occur. Those strategic steps have placed us in what I would refer to as a good place in terms of the operating budget. Last item I have is one of the opportunities to work with Chief Barnes of University Police as well as the thirteen other departments across campus. A quick reminder, tomorrow evening in front of Ellender Hall, Chief Barnes as well as some of our partners in the law enforcement community, Thibodaux Police Dept. and also Lafourche Parish Sheriffs Office are hosting the National Night Out event so it might very well come up while youre talking today. GUEST SPEAKER CONTINUED: COMMENT: President Cruz C. said one of his concerns is that when student organizations asked about reserving a room in the Coastal Center, we were told they would be charged a fee. Mr. Braud said we can go back and take a look at that. Again, as there are areas across the campus, we look for alternative revenue sources. We look at rental of spaces, etc. It may very well be that we can do that with a waiver in certain particular cases. For example, a student event that is really an off campus event but students are going to post that. Unfortunately, we have some very creative partners that realize when a student asks for a space, we may not charge them but really, its an outside event. We can certainly take a look at that to make sure we meet your needs. I had conversations with Presidents across all four (4) systems and we engaged in discussions about Financial Aid, AI policy, service projects, and other important information. Tomorrow, Director Justin H. and I will meet with SAAC/ACE to discuss expectations and goals for that special committee. Director Helper will be your liaison for all things ACE. Justice Elizabeth A. said we do have a budget but when we scheduled the Pickleball tournament, the prices were not this high. Theyve never been this high so were kind of overspending, having to pull from different areas. Were starting to take money from our Social budget.
