data-tab=\"1\" role=\"region\" aria-labelledby=\"elementor-tab-title-2091\"><p>On Wednesday, May 6, 2020, the Department of Education\u2019s Office for Civil Rights issued new Title IX regulations that will change the way institutions of higher education (IHEs) must address, investigate and adjudicate issues of sex and gender-based harassment, sexual misconduct, intimate partner violence and stalking.<\/p><p>The new regulations went into effect on August 14, 2020.\u00a0ÐÓ°É´«Ã½\u2019 existing Title IX\u00a0<a href=\"https:\/\/www.nicholls.edu\/titleix\/wp-content\/uploads\/sites\/149\/2021\/08\/Title-IX-\u2013-Notice-of-Rights.docx\"><strong><u>policies<\/u><\/strong><\/a>\u00a0are in full compliance with the current regulations. Similar to other IHEs across the country, the University will be required to amend those policies to comply with the new regulations.<\/p><p>ÐÓ°É´«Ã½ has already been reviewing our current policies in anticipation of the new regulations.\u00a0Now that the regulations have been finalized, we will spend the coming weeks carefully reviewing them and determining the best way to implement these regulations, ensuring we maintain processes that are thorough, equitable and sensitive to the needs of all parties.<\/p><p>At this time, ÐÓ°É´«Ã½\u2019 Title IX policies for reporting, investigating and adjudicating issues of sex or gender-based harassment remain unchanged, and any existing processes will continue under the current policies in place. Students have the right to pursue an education, including athletic programs, scholarships and other activities, free from sex discrimination, including sexual violence and harassment. Title IX of the Education Amendments of 1972 (20 U.S.C. \u00a7 1681 et seq.) requires schools that receive federal financial assistance to take necessary steps to prevent sexual assault on their campuses and to respond promptly and effectively when an assault is reported.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-2093\" class=\"elementor-tab-title\" data-tab=\"3\" role=\"button\" aria-controls=\"elementor-tab-content-2093\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><i class=\"fas fa-caret-right\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-opened\"><i class=\"elementor-toggle-icon-opened fas fa-caret-up\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-toggle-title\" tabindex=\"0\">Title IV of the 1964 Civil Rights Act<\/a>\n\t\t\t\t\t<\/div>\n\n\t\t\t\t\t<div id=\"elementor-tab-content-2093\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"3\" role=\"region\" aria-labelledby=\"elementor-tab-title-2093\"><p>This act (42 U.S.C. \u00a7 2000c et seq.) also requires public schools to respond to sexual assaults committed against their students.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-2094\" class=\"elementor-tab-title\" data-tab=\"4\" role=\"button\" aria-controls=\"elementor-tab-content-2094\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon elementor-toggle-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-toggle-icon-closed\"><i class=\"fas fa-caret-right\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span data-tab=\"4\" role=\"region\" aria-labelledby=\"elementor-tab-title-2094\"><p>The Jeanne Clery Disclosure of Campus Security Policy and Campus Crime Statistics Act (20 USC \u00a7 1092(f)), commonly referred to as the Clery Act, requires colleges and universities that participate in federal financial aid programs to report annual statistics on crime on or near their campuses&#8211;including sexual assault and rape and to develop and disseminate prevention policies.<\/p><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-toggle-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-2095\" class=\"elementor-tab-title\" data-tab=\"5\" role=\"button\" aria-controls=\"elementor-tab-content-2095\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<span as well as creating more prescriptive requirements for prevention and awareness programs related to these
